1. Your Account & Registration
- Account Obligation: To purchase products on mahamantra.co.in, you are required to register and create a user account. You are responsible for maintaining the confidentiality of your display name and password.
- Accuracy: You agree that if you provide any information that is untrue, inaccurate, or incomplete, we shall have the right to indefinitely suspend or terminate your membership.
- Electronic Communications: By creating an account, you agree to receive communications from us via SMS, Email, and WhatsApp regarding order updates, shipping alerts, and promotional offers. You may opt-out of promotional messages at any time through the “Unsubscribe” link.
2. The Contract: “Invitation to Offer”
- Order as Offer: Your order on this Website is an “offer to buy” the products in your cart. A contract of sale is only formed when Mahamantra Sugandh Vatika physically dispatches the product and sends you a “Shipping Confirmation” email.
- Right to Cancel: We reserve the right to cancel any order at our sole discretion before dispatch due to reasons including, but not limited to, technical errors, stock unavailability, or suspicion of fraudulent activity. In such cases, a full refund will be processed to your original payment method.
3. Pricing, Taxes & Payments
- Inclusive Pricing: All prices listed on the Website are inclusive of GST at the prevailing rates.
- Prepaid Only: We do not offer Cash on Delivery (COD). All orders must be fully paid via our secure payment gateways (UPI, Debit/Credit Cards, NetBanking).
- Payment Failure: In the event of a payment failure where funds are deducted from your account but not credited to us, the responsibility lies with the customer to resolve the matter with their respective bank or payment gateway provider.
4. Intellectual Property & Trade Secrets
- Proprietary Formulas: All fragrance profiles, dry-mix ratios, and manufacturing processes used by Mahamantra Sugandh Vatika are protected trade secrets. Any attempt to replicate or chemically analyze our products for commercial gain is a violation of these terms.
- Copyright: All content, including images, website wireframes, and text, is the exclusive property of Mahamantra Sugandh Vatika. Unauthorized use of our logo or brand name “Mahamantra” is strictly prohibited.
5. Reviews & User Content
- Moderation: We welcome honest feedback. However, we reserve the right to remove or edit any review that contains:
- Foul, defamatory, or harassing language.
- Spam or links to competitor websites.
- Misleading information about the product’s performance.
- License: By posting a review, you grant us a non-exclusive, royalty-free right to use, reproduce, and publish that content for marketing purposes.
6. Product Usage & Safety Disclaimer
- Safety Warning: Incense sticks and dhoop are combustible products. They must be used only in well-ventilated areas, kept away from flammable materials (curtains, wood, etc.), and kept out of reach of children and pets.
- Indemnity: Mahamantra Sugandh Vatika shall not be held liable for any respiratory issues, allergic reactions, or property damage resulting from the misuse of our products or failure to follow standard fire safety precautions.
7. Indemnity and Limitation of Liability
- You agree to indemnify and hold harmless Mahamantra Sugandh Vatika, its owner, and employees from any claim or demand made by any third party due to or arising out of your breach of these Terms.
- In no event shall our total liability to you exceed the amount paid by you for the specific product that gave rise to the claim.
8. Governing Law & Dispute Resolution
- Jurisdiction: These terms shall be governed by the laws of India. Any legal proceedings or disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra only.
